The H-1B program may undergo significant changes in the near future. The Department of Homeland Security U.S. Citizenship and Immigration Services recently published a 94-page proposed rule to "modernize" the H-1B program. The H-1B is a temporary (nonimmigrant) visa category for employers to petition for workers in "specialty occupations." A "specialty occupation" requires theoretical and practical application of highly specialized knowledge in a field such as architecture, engineering, mathematics, or the sciences.
This proposed rule represents one of the most substantial attempts to reshape the program in recent memory. For immigrants and employers who rely on the H-1B pathway, the implications are significant and wide-ranging.
