State Department Extends Nonimmigrant Visa Interview Waivers Indefinitely

The State Department announced an update to its discretionary interview waiver policy for nonimmigrant visa applicants. It replaces the temporary policies that had been in place for almost three years. Most importantly, the State Department made this a standing policy that will be reviewed annually, which will decrease uncertainty for many stakeholders.

Interview waivers have become an important part of how consular processing functions, and making this policy permanent is a meaningful shift for applicants and immigration practitioners alike. Rather than operating under temporary measures subject to expiration, consulates can now apply the waiver criteria with greater consistency and predictability.

The move is widely seen as a positive development for the many people navigating the nonimmigrant visa process, particularly those renewing visas in the same category or who otherwise meet the criteria for a waiver. The annual review structure means the policy can adapt over time while still providing the stability that applicants and legal professionals need to plan effectively.
